As of October 1, 2025, the monetary limit of the Ontario Small Claims Court has increased to $50,000.00.
This is great news for individuals and small businesses seeking affordable access to justice. The Small Claims Court has long been one of Ontario’s most practical and efficient legal forums. Now it can handle even more significant disputes.
Why So Many People Choose the Small Claims Court
The Small Claims Court is an essential part of the Ontario court system for two main reasons:
- Simpler process: The procedures are less formal and less paper-heavy than in the Superior Court of Justice.
- Affordable representation: You can hire a licensed paralegal instead of a lawyer. This means high-quality legal services at a significantly lower — and often pre-arranged — cost.
The Growth of Small Claims Court Monetary Jurisdiction
The claim limit in the Small Claims Court has been rising steadily over the years, reflecting the need for greater access to justice:
- 1993–2001: $6,000.00
- 2001–2010: $10,000.00
- 2010–2020: $25,000.00
- 2020–2025: $35,000.00
- Now (2025): $50,000.00
This increase allows many individuals and small businesses to resolve disputes efficiently, without the high costs and complexity of the higher courts.
Frequently Asked Questions (FAQs)
Can I split a larger claim into smaller ones to fit the $50,000.00 limit?
No. The Rules of the Small Claims Court do not allow you to divide a single case into smaller claims against the same person if they arise from the same issue. For example, if you have two unpaid invoices under one contract, you cannot file two $50,000.00 claims for each invoice separately.
My claim is slightly above $50,000.00. Can I still file it in the Small Claims Court?
Yes — you can. Even if your total claim is higher, you may waive the amount that exceeds $50,000.00 in your claim. By doing so, you can proceed in the Small Claims Court and still benefit from faster and more affordable proceedings. If your case is proven, the court may award you up to $50,000.00, plus interest and allowable costs.
Can I recover interest and legal costs on top of $50,000.00?
Yes. The $50,000.00 limit applies to the main amount of your claim. The court can also order the payment of interest and legal costs (within allowed limits) in addition to that amount if you are successful.
